The bank refused to pay the state tax . McCulloch doesn’t want to pay a tax to Maryland. John Marshal argued that Maryland had no right to tax the bank because it was a federal institution.
Gibbons v. Ogden
Gibbons has a license to operate a boat on federal water. Ogden has a NY license . Gibbons wants to operate on NY water . Ogden doesn’t want him to and points out that he doesn’t have a NY license . Gibbons wins cause it is not completely in NY
