Releasing CYP on bail
Bail conditions/opposition
Can be released on bail
Conditions must be discussed and agreed to by CYP. MUST sign bail bond
MUST appear in Court within 7 days
Bail conditions clear reasonable link to charges history and bail breaches
Suitable bail will reduce unnecessary breaches later
Complete opp to bail for those that need to bd is custody.
Bail continued for CYP
Youth Court will bail to:
OT custody
Rarely Police
Youth unit prison where 17 or more
Placing CYP in OT custody
Police obligations
Must place in OT custody as soon as practicable and no later than 24 hrs after arrest
Must
Deliver to social worker
Supply form (Pol 235) to social worker relating to
ID of CYP
circumstances of arrezt
Date and time of intended court apperance
NOTE
24 hr limit does not allow you to hold CYP for making further enquiries
Allow you to delay contacting OT for the max length of time.
Important to advise OT ASAP so they can find suitable placement. But should not affect transfer time frames.
Provision for holding CYP more than 24 hrs
If senior sergeant or above and delegate of CE of OT both sign joint certificate (Pol 236) if satisfied that CYP is
Likely to abscond or violent and
No OT facilities for safe custody are available
Can hold more than 24 hrs
BUT
must provide written report to Commissioner within 5 days and copy of certificate ststing
Circumstances certificate was issued and
DURATION CYP was detsinedor likely to be detained
