What must be considered when determining how a deceased’s estate will pass?
- Whether the deceased left a valid will

What is a ‘testator’?
A person who has left a valid will
What does the term ‘succession estate’ refer to?
The collective assets capable of passing under a will or by intestacy
What is meant by ‘testate’?
The deceased’s will covers their entire succession estate
What is ‘partial intestacy’?
When the will does not cover the entire estate, leading to intestacy rules applying to remaining property
What does it mean if a person dies ‘intestate’?
They died without making a valid will

They do not form part of the succession estate
