What are the 6 principles that guide Police practice to the response of family harm incident. What are the police actions under each principle?
- Early intervention
Recognizing the early intervention helps to stop and prevent family harm. - Culturally appropriate
A sensitive approach at all family harm investigations that acknowledges the culture of those involved and provides culturally appropriate solutions. - Safety
a) Ensuring all parties are safe and kept safe.
b) Children’s safety as they are vulnerable
c) Officer’s safety. - Collecting risk information
Effectively collecting risk information to enable assessment, planning and risk management to victims and to guide decisions around appropriate actions for offenders. - Accountability
a) Holding offenders accountable for their actions.
b) Directing offenders to supportive interventions to change their behaviors in order to to stop and prevent harm. - Working collaboratively
Police must:
a) Coordinate responses to family harm through family violence coordinators across relevant internal work groups .
b) Be part of a coordinated collaborative multi agency table response.
c) Provide quality information to multi-agency tables which enables to best support for families in need.
d) Apply active case management principles and processes.
When a protection order has been breached and there is evidential sufficiency to prove a charge, you must:
a) Charge the offender with the breach.
b) Not release the offender on police bail for 24 hours unless there is a court hearing earlier than this where court bail can be determined.
What is the primary consideration of granting family harm offender police bail?
a) the safety of the victim and their family members,
b) linking the victim to appropriate support and service
c) and possible need for defendant to have a cool off period.
What is the immediate effects of a PSO to the person bound?
a) Surrender any weapon in their control or any firearms license held to a constable
b) Vacate any land or building occupied by the person at risk
c) Provide a cooling down period and space for person at risk to eek support and assistance.
What is the effect on parenting order when a PSO was issued?
Parenting order is suspended.
When can a safety order be issued?
a) does not arrest the person posing risk for a family risk for family violence offense against the person at risk.
b) has reasonable ground to believe, that an order is necessary to help make the person at risk safe from family violence.
When can a safety order not be issued?
If the person posing risk is arrested for a family violence offense. or the person posing risk is aged under 17 years.
Police power pending authorization and issue of an order.
Police constable may:
a) Detain the person up to two house to obtain necessary authority and to issue and serve the order on that person.
b) Remove the person from the premises and to a police station or place used as a police station during the detention.
Duration from issuing a PSO to serve the order on person
48 hrs.
A warrant can be applied for person who breached PSO for his/her arrest. How long is this warrant active for in NIA?
How much time do you have to locate and arrest this person?
10 days.
1 month.
A Protection Order must be served by police if:
a) the respondent holds a firearms license
b) the respondent is believed to be in possession of or have access to a firearm
c) service is assessed as being a significant risk to the server
d) the protection order is granted without notice.
A protection order automatically affords proetcion to the applicant and …?
any child of the applicant’s family. Child aged 17 years and older remains protected until they leave home.
Any adult children not living with the applicant must be identified on the order as a specified person.
