What are the Mohan Criteria? Define.

A

Must be relevant to the case (must be involved in specific incident)
Must be necessary to assist the trier of fact (help jurors)
Must not violate any rules of exclusion (cannot bring in things that were already tried)
Must be provided by a qualified expert (registered psychologist)

What is one issue with each Mohan Criteria?

A

Must be relevant to the case: we do not necessarily know what will be relevant
Must be necessary to assist the triers of fact: Court defines necessary
Must not violate the rules of exclusion: Past issues that were relevant often do not count, cannot help with character judgement
Must be provided by a qualified expert: What qualifies them
