101.2 Scope

Section 102
Applicability
102.1 Construction and design provisions…apply to
- structures , facilities and conditions arising after the adoption of this code
- existing structures, facilities and conditions not legally in existence at the time of adoption of this code
- existing structures, facilities and conditions where required in chapter 11
- existing structures, facilities and conditions that, in the opinion of the fire code official, constitute a distinct hazard to life or property
102.3 change of use or occupancy…and exception
shall not be made unless comply with this code and California Existing Building Code…exception: fire code official approves as less hazardous, based on life and fire risk
102.4 application of building code
design and construction of new structures shall comply with the California Building Code
102.5 application of residential code

Shall not be mandatory for existing buildings or structures classified by the state or local jurisdiction as historic buildings

Section 103
Department of Fire Prevention
Function of the Department of Fire Prevention
Implementation, administration, and enforcement of the provisions of this code
103.2 Appointment
The fire code official shall be appointed and removed as provided by the City Charter
103.3 Deputies
Fire code official shall have the authority to appoint a deputy fire code official, other related technical officers, inspectors and other employees
103.3.1 Office and duties of the Fire Marshal
The office of the Fire Marshal is hereby created in the City of Los Angeles
103.3.1.1 Designation of the Fire Marshal
Chief shall designate a Deputy Fire Chief of the Department who shall serve as Fire Marshal with the authority to exercise the power and perform the duties of the Fire Marshal
103.3.1.2 Control of matters
The Fire Marshal shall, under direction of the Chief, have control of all matters pertaining to the Bureau of Fire Prevention and Public Safety
103.3.2 Bureau of Fire Prevention and Public Safety (when)

103.3.2.1 Composition of the Bureau of Fire Prevention and Public Safety
- The Fire Marshal, who shall be the Chief Fire Prevention Engineer of the Bureau of Fire Prevention and Public Safety

103.3.2.2 Function
- Prevention of fires
- Investigation of cause, origin and circumstances of fire life safety hazards
- Elimination of fire and life safety hazards in any building or structure, including those under construction, any premises, marine vessel, aircraft, vehicle, or the appurtenances and equipment thereof
- The maintenance of fire protection equipment and systems
- The regulation of storage, use and handling of hazardous materials and hazardous substances
- Enforcement of the basic building regulations of the State Fire Marshal as the apply to the City of Los Angeles in matters relating to fire, panic and explosion safety
103.4 Liability
While acting for the jurisdiction, in good faith and without malice… shall not thereby be rendered civilly or criminally liable personally
103.4.2 Responsibility of City
Neither the City nor any department, board, commission, officer or employee thereof shall be held liable or responsible for any damage or injury…

Chief shall have the power to make and enforce rules and regulations for the purpose of prevention and control of fires…
104.3 Right of entry
Fire code official has reasonable cause to believe…authority to enter…perform the duties imposed by this code… reasonable effort to locate owner… if refused, recourse to every remedy provided by law
104.6.1 Official Records
Keep records for not less than 5 years or for as long as the structure or activity to which such records relate remain in existence
