What if a testator marries?
Marriage after execution of will has no affect on the will but may affect gifts and dispositions.
What if a testator divorces/annuls/separates?
If the Court renders final decree of divorce, annulment or separation after execution of a will, all gifts, fiduciary appointments in favour of the former spouse are revoked by operation of law. Its as if the the spouse pre-deceased the testator.
Whats the exception to the rule that the former spouse is treated as being pre-deceased and locked out of the will?
All gifts and fiduciary appointments in favour of issue of former spouse are not revoked.
What if they reconcile or remarry?
The provisions in favour of the former spouse are restored.
