What points did Beccaria come up with?

A
  1. Crime is rational
  2. People are rational beings
  3. People calculate the consequences of their actions
  4. Deterrence is the way to go
  5. If punishments are severe criminals would see that they will not profit from crime
  6. Law would be effective because people could read it and understand it
  7. Judges powers should be restricted
  8. Punishment should fit the crime not the person

Should we do all these things today though?

We do. bUT WE SHOULDN’T.

Not all crimes are rational. Some people are ill in many different ways
All though this is a logical approach, not entirely accurate. Just because you are logical does not mean you are correct.
