What does the success of a government depend on?
The success of a government depends, to a large extent, on how well it is able to maintain law and order.
Who helps the government maintain law and order?
The judiciary and the police force help the government to maintain law and order.
What is the main aim of the judiciary and police force?
Their main aim is to check crime.
What power does the government give to the police?
The government gives power to the police to take action against crimes.
What are cognisable offences?
Cognisable offences are those for which the police can arrest a suspect without court permission based on reasonable evidence.
Examples include murder, robbery, theft, kidnapping, and rioting.
What is required for non-cognisable offences?
For non-cognisable offences, the police need a warrant to arrest the suspect.
What is bail?
Bail is money that somebody agrees to pay if a person accused of an offence does not appear for trial.
Are all offences bailable?
No, all offences are not bailable.
What happens if a person is arrested for a bailable offence?
A person arrested for a bailable offence has the right to be released on agreeing to pay bail without having to apply to a court.
What must a person do if the offence is not bailable?
The arrested person must apply to a court for bail.
What happens once bail is arranged?
Once the bail is arranged, the arrested person is released from jail on signing a bond to appear for trial at a specified time and place.
What is a surety?
A surety is a person who takes the responsibility of making the suspect appear for trial.
What rights does an arrested person have in India?
The constitution and criminal laws of India give certain rights to an arrested person, including the right to be informed of the reason for arrest and the right to consult a lawyer of choice.
What is one of the rights of an arrested person regarding custody?
The right to be produced before a magistrate within 24 hours of arrest, and not to be kept in custody beyond that time without the magistrate’s permission.
What does the right not to be tortured include?
The right not to be tortured includes the right not to be deprived of basic necessities of life such as food, clothing, and shelter.
What is the right against self-incrimination?
The right not to be forced to be a witness against his or her own self.
What special provision is there for boys aged below 15 and women?
They have the right not to be called outside their residence only for questioning.
What are the DK Basu Guidelines?
The DK Basu Guidelines are a set of guidelines issued by the Supreme Court that must be followed while arresting, detaining, and questioning a person.
What must police personnel do during an arrest?
Police personnel who make the arrest or do the questioning must wear accurate, visible, and clear identification and name tags with their designations.
