Civil liberties
Individual rights that are guaranteed by the Constitution enumerated in the Bill of Rights the first ten amendments
Civil rights
Concerned with the protection against discrimination derived from the Equal Protection Clause of the 14th Amendment
First Amendment
Freedom of press religion assembly and petition
Second Amendment
Right to bear arms
Third amendment
Quartering of soldiers you can be free from the government forcing you to let soldiers stay in your house without permission
Fourth Amendment
Arrest and searches
Fifth Amendment
Provides protection against self-incrimination and double jeopardy
6th amendment
Ensures that the accused will have legal representation and a speedy public trial gives the right to be informed and cause of accusation
7th amendment
Guarantees trial by jury in civil cases where the value of the issue needing resolution exceed $75,000 applies to federal civil cases only
8th amendment
Prohibits excessive bail and cruel and unusual punishment
9th amendment
Reserves other rights not mentioned in the Constitution for the people and by the people
Tenth Amendment
Reserved powers not delegated to the federal government to the states and the people
Selective incorporation
Incorporation of rights on a case by case basis
The Establishment Clause
Major issues pertaining to church/ state associations
Examples of the Establishment Clause
Public funds to religious parachial schools prayer in public schools and religious displays on public property
