Q

If criminal charges are pending, how should an EUO be approached?

A

Cannot demand EUO and deny for no show. This would be bad faith. Management needs to help decide if EUO should be done. Criminal charges don’t eliminate obligation to appear for EUO but it is better to wait (unless the investigation will b prejudiced by the delay)
