Covenants, conditions and restrictions (CC&Rs)
Recorded restrictions against the title to real estate prohibiting or limiting Specified uses of the property.
Affirmative covenant
A recorded restriction limiting the use of a property to a specific purpose.
Negative covenant
A recorded restriction prohibiting identified uses of a property.
Preliminary title report PRELIM
A Prelim Discloses the results of the title companies search of the properties title history.
It functions with a very limited purpose of the title companies revocable offered to issue a title policy.
Personal covenant
The restriction is only enforceable as long as her original buyer holds title.
The restriction against use is a personal promise, it does not run with the land and cannot be imposed on the developer who acquired title.
