If the duly authorised officer decides that the person needs to have a medical examination, but not urgently, he or she must?

  • Arrange/assist arranging medical practitioner to examine with a view to issuing a certificate under section 8B(4)(b); and
  • Once certificate Issued, apply/assist someone else, for assessment under section 8A
  • and
  • Arrange for an assessment examination to be conducted under section 9.

If the duly authorised officer decides that the person needs to have a medical examination urgently, he or she must?

  • Try to get a medical practitioner to examine /issue a certificate under section 8B(4)(b); and
  • If MP available, examine person, (police can assist s 41) and
  • If MP not vailable, try to go willingly; and
  • If refuses, take all reasonable steps to—
    (i) Take the person
    (ii) Ensure that the medical practitioner is able to examine the person, including calling for police assistance under section 41; and
  • Once a certificate is issued under section 8B(4)(b), assist someone else to apply under section 8A for assessment of the person, or apply himself or herself if nobody else is willing to apply; and
  • Arrange for an assessment examination to be conducted under section 9

Section 39 – Assistance in respect of outpatients and inpatients on leave

Anyone may at any time request the advice or assistance of a duly authorised officer in relation to any aspect of the care, treatment, or conduct of a patient to whom this section applies.

On any such request, a duly authorised officer shall take the following steps?

  • Investigate the matter/extent/necessary/satisfy himself or herself that the concern is valid, RGB further consideration of the case may be desirable:
  • Inform the responsible clinician or any other appropriate person of the grounds of concern that have arisen in the case:
  • Give such other advice or assistance in the matter as may be appropriate
