Group of persons protected by specific laws b/c of the groups defining characteristics. Unders laws prohibiting employment discrimination, these characteristics include race, color, religion, national origin, gender, age, & disability.
Protected Class *
Treating employees/job applicants unequally on basis of race, color, national origin, religion, gender, age, or disability; prohibited by federal statutes.
Employment Discrimination *
Form of employment discrimination that results when an employer intentionally discriminates against employers who are members of protected class.
Disparate- Treatment Discrimination *
Form of employment discrimination that results from certain employer practices/procedures that, although not discriminatory on their race, have a discriminatory effect.
Disparate- Impact Discrimination *
termination of employment brought about by making the employees working conditions so intolerable that the employee reasonably feels compelled to leave.
Constructive Discharge
Employment context, demanding sexual favors in return for job promotions/other benefits/ language/ conduct that is so sexually offensive that it creates a hostile working environment.
Sexual Harassment *
Significant change in employment status, brought about by firing/failing to promote an employee; resigning employee to a position w/ significantly different responsibilities; effecting a significant change in employment benefits.
Tangible Employment Action
Defense to allegations of employment discrimination in which the employer demonstrates that an employment practice that discriminates against members of a protected class is related to job performance.
Business Necessity
Identifiable characteristics reasonably necessary to the normal operation of a particular business. These characteristics can include gender, national origin, & religion, but not race.
Bona Fide Occupational Qualification (BFOQ)
System in which those who have worked longest for the employer are first in line for promotions, salary increases, & other benefits. Also the last to be laid ff if the workforce must be reduced.
Seniority System
Job-hiring policies that give special considerations to members of protected classes in an effort to o/come present effects of past discrimination.
Affirmative Action
Case in which the plaintiff has produced sufficient evidence of their claim that the case can go to jury; case in which the evidence compels a decision for the plaintiff if the defendant produces no affirmative defense/evidence to disprove the plaintiffs assertion.
