‘you don’t have to wait’ does not mean ‘you must not wait’, so it’s not ‘no tiene que esperar’ but ‘no es necesario que espere’. ‘could’ in English means both ‘was able’ and ‘would be able’. ‘podría’ is ‘could’ if it is not clearly in the past.
