What does CBA pertain to?
The terms & conditions of the wages, hours, and working conditions of the Lex PD
Who does CBA cover and not cover?
Covers sworn, non-Prob Ofcs & Sgts
Does not cover non-sworn, probies, or ranks outside Ofc & Sgt
Who is sole rep of LFUCG?
Mayors rep & designee
How does Probationary period work?
18 months from hire date on Probation, may be extended 2x in 90 day increments, for total of 6 months addl Probation, in extraordinary circumstances Probation may be extended beyond the 6 months if requested by Trainee and agreed to by LFUCG. In case of sick/military/disability/mod duty that exceeds 80 hours, Probation may be extended for that same length of time
What rights does LFUCG retain with CBA?
Rights to
- determine org structure of PD and all parts
- promulgate policies & regs
- assign personnel
- make rules for hires & promotions
- set standards of performance & service
- relieve law enforcement powers, any suspension from pay is a ‘disciplinary action’
- eliminate positions
How are strikes/work stoppages/slowdowns viewed?
- unlawful to engage in strikes
- Lodge shall not encourage any work slowdown or pickup in work production
- any member who engages in above may constitute cause for Termination
- mass resignations or call-ins shall be deemed strikes or work stoppages
How are layoffs viewed?
- if layoff necessary, LFUCG will notify all members and Lodge at least 30 days from layoff date, layoffs done inverse order of seniority
- any member receiving notice of layoff has 10 days to bump least senior member within same or lower rank, that member then has 10 days and so on
- members laid off shall be placed on Recall list for 30 months, if recalled back placed at same grade & seniority at time of layoff, notice of recall sent by certified mail return receipt requested
- recalled members have 10 days following mail receipt to notify LFUCG of intention to return to work, and 14 days to return to work unless other date specified
- a laid off member has right to receive payment for all V/H time in bank
- health/life insurance coverage continues til end of next full month after layoff date
What are ‘days’ in CBA?
Calendar days unless otherwise specified
How does Lodge view membership?
Not a condition of employment, members have right to join / not join, Lodge shall represent all members regardless
Can LFUCG discourage membership in the Lodge?
No
How do members join/withdraw from Lodge?
Written notice to Lodge & LFUCG
How do members pay union dues?
Regular payroll deductions each month, they’ll continue until member revokes consent by written notice to LFUCG & Lodge, dues always deducted from 2nd pay period each month, LFUCG delivers dues to Lodge Treasurer by 15th of next month
How often Lodge need to certify amount of union dues?
Annually in writing to LFUCG, if dues changed LFUCG will deduct new amount on next calendar month after the change
How do non members contribute for CB expenses?
Non members may compensate Lodge for CB expenses incurred for negotiating, Lodge informs LFUCG and non members by 12/15 of each year, non members authorize by monthly payroll deduction
How does Union Business time work for Lodge reps?
Lodge may select up to 8 persons plus President to rep Lodge during negotiations, without loss in compensation, straight time only, provide notice to Chief 14 days ahead, 48hrs notice beforehand of change in reps
How does Union Business time work for Grievances?
A max of 3 reps from Lodge plus Pres allowed time to process grievances, straight time only, 3 reps designated within 30 days after CBA made, changes to reps must be sent to Chief 48hrs before change, only Pres plus 1 of reps eligible per Grievance meeting
How does Union Business time work for Gen Assembly?
Lodge may select up to 4 reps who can attend up to 80 hrs of KY Gen Assembly, Pres can’t be rep, reps submitted to Chief at least 14 days beforehand
How does Union Business time work for Presidents time?
If Pres is active sworn member of LPD, he has 500 hrs for Lodge business each fiscal year, and can let reps use time for him
How does Union Business time work for Natl Conference & State Lodge Board?
Chief authorizes leave with pay for 7 elected delegates to attend
How does Union Business time work for Local Board time?
Elected board members can attend meetings without loss in pay up to 6 hrs a month, with 48 hr sup notice
What does LFUCG provide the Lodge for notice posting?
Designated space on bulletin boards, must be in good taste
Can Union Business time ever be OT?
No, straight time only
When does Seniority begin?
First date of employment as Trainee, alternates have same as rest of class, any KY Police Corps Program member from classes 06/2001 and 06/2002 have that Basic date as their seniority date, besides for promotions & pension benefits
Seniority is continuous unless what ?
Terminated
Laid off more than 24 mos
Doesn’t return to work 30 days after layoff recall
Resigns, unless comes back within 1 year and loses time he was gone but gets rest back after 1 year
How does anni date get figured for members who resign and come back?
Original hire date adjusted forward length of time they were gone, step increases continue as normal immediately
How does seniority work for Sgts?
By date of promotion, if that dates the same for 2 Sgts then prom list ranking
How does seniority for tied Ofcs work?
Goes by final class ranking, seniority shall be a factor for specialized schools, and LFUCG shall annually give Lodge a seniority list
How do sector bids work?
Bids handled twice annually, Ofcs will have min of 10 days from opening of bid process to submit their prefs to BOP Asst Chief, all goes by seniority
What are exceptions to seniority in shift bids?
The PD may make temporary assignments to fill vacancies til next bid
Seniority may be overlooked to prevent bulk of brand new Ofcs on same shift
How do beat bids work?
Based on seniority, sector Cmdr can overlook for legit managerial reasons
How do Sgt vacancies work?
Posted for min of 10 days, Sgt bidding for it with most seniority gets it, besides if overlooked to prevent bulk of brand new Sgts, temp fixes for that will be corrected within 90 days
How do non-Patrol units work for applying?
Must have 3 years by app deadline, must be posted for min of 10 days thru Dept wide email
