Wescott v. First & National Bank
A
Facts: WWII solider. Sends letters from abroad to open an account, and if he shall die the money shall go to his grandfather after 5 years.
Holding: Letters were not offered or proven in the manner and form prescribed by statutes so as to constitute a valid will. It was a gift because there was no delivery. Not a trust b/c there wasn’t a trustee or beneficiary.
