Child and Young Person
Child : Person under the age of 14 years.
Young Person: Means a person of or over the age of 14 years but under the age of 18 years. (14-17).
Paramount Consideration when dealing with Children and Young People.

Section 48 : Oranga Tamariki Act
- Where a CYP is found Unaccompanied by a parent/ guardian
- in a situation where there health is likely to be impaired
- a constable may use such force as reasonably necessary take the CYP
- with their consent Deliver them into the custody of parent/guardian
- if no consent is given or caregivers are unwilling to take them place the —child in the custody of OT.
Section 42: Oranga Tamariki Act
Entry and Search without a warrant any place to protect any CYP from injury or death.
Any member of police using this power must:
- On first entering and upon request, produce evidence of identity.
- State they are using section 42 of the Oranga Tamariki Act 1989
- Within in three days inform the commissioner of the use of this power by forwarding a CYP Arrest/removal notification.
Reporting Requirements : Use of powers
- Commissioner’s Report completed by OT
- Includes:
- reasons for taking action
- evidence on which those reasons were based
- the solution that was reached.
Section 10B : Summary Offences Act
Leaving a child without reasonable supervision and care.
- Being a parent or guardian or a person having the care of a child under the age of 14.
- Leaves that child
- without making reasonable provision for the supervision and care of the child.
- for a time that is unreasonable or under conditions that are unreasonable having regard to all the circumstances.
” In need of care and protection”
- Parents/caregivers who abuse/ ill-treat their children or are unable or unwilling to look after them.
- Children to Young Persons who will not obey/listen to their parents or wilfully misbehave to serious degree.
