4 options for a contract with a minor
- necessities
- binding unless repudiated
- binding if ratified
- always void
Contracts for necessities:
absolutely binding on a minor
s.7 Goods Act (Vic) 1958
only has to pay reasonable price
what is a necessity?
goods suitable to the condition in life of such minor or other person and to his actual requirements at the time of the sale and delivery”

education/apprenticeship

If the minor already has adequate supply there is no necessity
Binding unless repudiated
voidable at the option of the minor - binding unless repudiated by the minor during minority or within a reasonable time after turning 18

Effect of the repudiation
the minor will not be liable for future obligations, but bound by obligations accrued before ratification
Supreme Court Act 1986 (Vic) s.50
○ No proceeding to be brought on ratification of minor’s contract

Can minor rely on contract not ratified/void?
• Note that the contract may (even if not ratified) still be relied on and enforced by the minor by way of a damages claim (not specific performance)
