the Ontario Court of Appeal and the court stated that the prohibition on the possession of marihuana for medicinal purposes offends the principal of fundamental justice.
Marihuana Medical Access Regulations (MMAR) in 2001
The MMAR enabled individuals with the authorization of their health care practitioner to access a supply of dried cannabis for medical purposes from a Licensed Producer (LP), Prairie Plant Systems. The MMAR permitted a mail order system where cannabis was sent through the mail to the individual.

R. v. Smith
In June 2015, the Supreme Court of Canada, in R. v. Smith, decided that individuals with a medical need should have the right to use and make other cannabis products rather than restricting them to dried cannabis only. (they can make cannabis oils)
What is not defined as cannabis in the plant?
Non-viable seeds, mature plant stocks without leaves, cannabis roots, or fibre derived from cannabis stalks, are not considered to be cannabis under the Cannabis Act.

Cannabis have strict packaging and labelling requirements
hese packages will contain no more than 30 grams of dried cannabis (taking into consideration the equivalent amounts)
The package must have the “red stop sign” THC logo, contain a warning label, and must not appeal to children (i.e., not use a person, celebrity, character, or animal to endorse the product) or evoke a lifestyle that is glamourous or daring.
MMAR possession
Those individuals can show proof of their legal authorization to possess cannabis for medical purposes and their authority to produce cannabis by providing law enforcement with a copy of their pink-colored authorization to possess, their personal use production licence, or their designated person production licence. The maximum MMAR possession amount in public is the equivalent of the maximum quantity of dried cannabis specified in the authorization to possess or the equivalent of 150 grams of dried cannabis, whichever is less.
