What’s the definition of burglary with intent?
“Any person who enters a building or part of a building as a trespasser with the intent to steal anything in the building or inflict GBH on any person therein or do unlawful damage to the building or anything therein shall be guilty of an offence…”
Does a person commit burglary just by stealing?
No, they must trespass into a building and steal from it for it to be burglary
Can they be charged with burglary with intent even if they haven’t stole?
Yes, the offence only requires intent to steal
If they assault someone while trespassing does that count?
No, they must cause GBH on someone in the building they’re trespassing in
What else must they not do?
Damage the building or anything within it unlawfully
