Development and reform
The Law Commission considers areas of law which are in need of reform:
Commission may choose areas in need or reform
Lord Chancellor (on behalf of Gov) may ask the Law commission to look into the specific areas of law
The law commission the researched the area of law and produces a consultation paper which explains the law and examines options for reform. Following the consultation, the Commission will then produce a final report which recommends changes and may attach a draft bill. However, it is up to the Government whether to push the Bill through Parliament.
Codification
Codification is where the law commission reviews the current law and created a code which will set out all of the law in that area in a codifies manner. The code will include existing law (common and statutory law) and create new laws.
