Tenure court case
Board of Regents of States Colleges v. Roth (1972):
A contract is needed for tenure. Due process applies to public universities because dismissed employee has property interest.
Other: Board of trustees were over professors in 19th century. G.B. Halstead was dismissed from TX after 19 years of service in 1903. This helped to accelerate formation of AAUP and the “1940 Statement of Principles on Academic Freedom and Tenure”
In loco parentis court cases
Dixon v. Alabama (1961): Courts sided with Dixon after he was removed from school for skipping lunch and attending a protest. This case signified the end of in loco parentis.
Grosser v. Trustees of Columbia University (1968): Columbia is a private university so students did not have free speech rights during sit in.
1970’s Bystander ERa
Furek v. U of Delaware (1991) Tort law applies. University lost after student sued post hazing accident
Lehigh v. Booker (1992): Drunk student fell and sued U for damages. Courts sided with the college because student made he own adult choice to drink.
