Q

What was happening for you from 2012 to 2014? Did you ever have to borrow any cash?

A

Working odd jobs, waiting tables, searching for a permanent gig. Tried to save money, but was constantly short of cash. Borrowed money a few times from friends and tried to pay them back. Still feels bad from not paying them back, makes you sick to your stomach. They stopped loaning money eventually. Never paid all the money back.

Q

Who led the band? What was he like?

A

Marlo Hubbard, “a real piece of work”. Described himself as “Don Felder reincarnated”, even though Don Felder is not actually dead, but Marlo doesn’t care.

13
Q

What was the leader of the band’s way of of taking care of the band? How did he treat Gunn?

A

Marlo basically exercised dictorial control over every aspect of the band. he picked songs, gigs, chose the solo, and controlled money with no visibility. You are sure he was shortchanging you. He made jokes about bassists (“ what do bassists and a lawsuit have in common? Everyone feels a lot better when the case is closed!”)

Q

What was the last straw for you with Marlo Hubbard?

A

After a gig, Marlo tried to dock your pay because he thought you were out of tune the second half of the show. You barely had enough money for food and rent, so you snapped.

A

Mad about dock in pay. You yelled at him, punched him hard, then took a bit of cash from his wallet to cover what he owed me when he was distracted. End of time in music industry.

Harper Meadows. You got to know her pretty well. You think she is definitively a penny- pincher, willing to shade the truth if it can help her make an extra buck.

24
Q

What events happened with Harper Meadows before the incident to make you distrust her?

A

You performed services or installed bank upgrades that Harper had verbally approved in advance. Then, when your office got the bill, Harper would say that she never approved the expenses and wouldn’t pay them, even when she knew that she owed money. This made you stop suggesting upgrades because of it, but you didn’t want to ruin the relationship.

A

You don’t remember if you ever did, but it sounds like something you might have done, you guess. You don’t remember ever suggesting to Harper to install the security system, and you would have been surprised if she had agreed to scheduling it anyway.

Q

What was the story behind getting a loan to buy your dream home?

A

You went into Harper’s office after an inspection and you needed a mortgage to finance what the down payment wouldn’t cover, and you asked Harper for help. She was very willing to help and sat down right away to run the numbers. She was concerned when she saw your credit report, because your credit report wasn’t stellar. You were worried you would lose the house, but Harper gave you the loan, and you signed the paperwork the next month.

Q

What was your house like?

A

It was your dream to own a home since you arrived in Cache County. The property was near the city park in Kuigley Crossing. it was small, but was your dream house! it had two bedrooms, a wonderful kitchen, and a great deck that backs up to the baseball field. It’s a short walk, like maybe ten minutes, to your favorite coffee shop, Keira’s Yogurt and Coffee.

35
Q

What was your new boss’s name at the security company?

A

Amy Jamieson

36
Q

Why did Dewing Security fire you?

A

Amy claimed you were embezzling money from the company. You asked her for proof, and she just said “I have enough. Go collect your things and turn in your keys.” You say that what she was telling you was completely untrue. You had never stolen anything from anybody, and you still don’t know why you were let go.

37
Q

What was so bad about getting fired?

A

What were you going to do? You only had enough money for one more mortgage payment if you were to buy food and pay utility bills.

38
Q

What months could you pay the mortgage?

A

February

39
Q

What months could you not pay your mortgage?

A

march, april, may, June, July, august

40
Q

what were you doing while you weren’t paying off your mortgage?

A

Looking for a new job, but it was hard, because dewing wouldn’t give you a reference

41
Q

Why didn’t you reach out to the bank?

A

you wish that you did, since Harper was so kind to you, but you were too embarrassed to call.
In May, the phone company disconnected your landline (because you didn’t pay your monthly fees), so the bank couldn’t contact you after that, since it was the only number you gave to the bank.

42
Q

why didn’t you reach out to the bank after you knew you couldn’t pay your mortgage?

A

You were really embarrassed to call them, but you wish you had, since Harper is so kind to you, and you felt like you owed her an explanation.

43
Q

Why couldn’t you call the bank in may and after?

A

The phone company disconnected the non-payment of the mortgage fees, which was the only phone number that you had given the bank.

44
Q

Did you have a phone besides your landline?

A

Yes; you carry it everywhere. it is a google pixel that runs on the Android system and was logged into your personal google account. this made losing the landline not that big of a deal.

45
Q

Tell me about the security on your cell phone

A

Some of your friends are shocked that you do this, but you always have your location service on. you don’t care about security on your phone since the government can track you anyway, so why worry?

46
Q

When did you have any contact with Harper after you didn’t pay your mortgage?

A

Sometime toward the end of May, she came to my door to talk

47
Q

what did you and Harper talk about when they visited you?

A

Harper asked if everything was okay, then you explained what had happened (you lost your job, going through a hard time)
Harper asked if you could start paying your mortgage bills again, and you said you would do your best.

48
Q

What did Harper say when you were talking about paying the money in May?

A

“Look, Bobbie, this can’t go on forever, but we’re going to find a way to figure this out. Just don’t worry.” Harper definitely didn’t say anything about the July 1st deadline

49
Q

How did you feel after your meeting with Harper in may?

A

reassured in a way you hadn’t been in months. you knew Harper was looking out for you

50
Q

did you ever talk to Harper after the talk you two had?

A

No- it was the last time you heard of them before you were arrested

51
Q

did you ever see the letter the bank sent to you regarding the mortgage?

A

definitely not until you saw it when the state produced it for the case

52
Q

did you know about the foreclosure? When was the foreclosure?

A

no, you didn’t know. Harper made it sound like the bank would take care of you
it would begin on August 13th if you didn’t pay

53
Q

Was the letter in your mailbox? did you see it?

A

maybe it was in there, but you don’t check your mail that often, since you do everything electronically.
you are positive that you didn’t see it until November or December

54
Q

Did you ever try to contact Harper after your conversation?

A

yes- on the 8th of August, but when you got to the bank, you saw that it was closed, so you went back

55
Q

Did you know about the foreclosure? when was it?

A

No- you were unaware of the foreclosure on August 13th if you didn’t pay.

56
Q

Why did you sell your car?

A

You felt worse and worse about the mortgage payments that you knew you had to sell your car, even though you didn’t like it. You did it to get current on your mortgage payments, even if you didn’t know how to pay the rest after that.

57
Q

Why were you so hesitant to sell your car?

A

You really needed it to get around, since you live in a food desert. it’s a 3 and 1/2 mile hike to get to the nearest grocery store (thanks, amazon!). you also needed it if you were going to get a new job, but you were out of options.

58
Q

How did you sell your car? When was this?

A

on August 9th, you put it on Craigslist, and you got a buyer in about an hour.

59
Q

What model car was it? What was its condition?

A

1996 Lincoln Town Car. dark blue. it was old, but in really good condition, since you had always taken really good care of it.

60
Q

How much did you get for selling your car? What was special about this price?

A

$3,500. a little more than double its bluebook value.

61
Q

What can you remember about the person who bought the car? How did he pay?

A

You don’t remember the name or much else, other than he payed cash, in small bills (annoying!). He said he was a collector, and he was in a hurry to buy it and didn’t negotiate the price.

62
Q

What happened after the man decided to buy your car? What did you do and forget to do?

A

You took the license plate off the car, but you forgot to give him the title, and he didn’t ask for it, and you had no way of contacting him. You deleted the craigslist ad that you made, so you don’t have a copy of it, and you don’t think that craigslist kept archives of ads.

63
Q

What did you do later that day after selling your car?

A

You were feeling pretty good, so you went to Fat Cat’s Casino near Riverville to gamble.

64
Q

Where do you go to gamble? where is it?

A

Fat Cat’s Casino near Riverville

65
Q

Why did you go gambling after selling your car?

A

You were feeling good, and you wanted to make the $3500 that you made into a little more. You are really good at poker because you have been doing it since your music days.

66
Q

How did you get to Fat Cat’s Casino without a car?

A

Fat Cat’s runs a free shuttle which stops in a few towns in Cache County, including Kuigley Crossing.

67
Q

When did you get to Fat Cats the day when you sold your car?

A

around 4:30

68
Q

Did you talk to anyone at Fat Cat’s on the first day at the casino after selling the car?

A

You chatted with Dakota Prescott in the cage before you hit the floor. You told them that you had just sold your car.

69
Q

How much did you gamble on the first night after selling your car? how well did that go for you?

A

You weren’t going to risk all of your money, so you went in with $1500. that is more than you usually play with , but you did because you were feeling good. You had a great night and walked away with something like three or four grand over the initial buy in. so about $4,500-5,500.

70
Q

Why was there no evidence if you earning as much as you did at the casino on the night that you sold the car?

A

Because of the amount you started with, the casino didn’t have to give you any tax forms for any of your winnings.

71
Q

Did you talk to anyone else the day that you sold your car?

A

Dakota, the poker dealer, other unfamiliar players, and the car collector. you didn’t see or speak to anyone else that day.

72
Q

what did you do the day after selling your car? what date was this?

A

August 10th, you were planning on making your mortgage payment, but because you did so well the day before at Fat Cat’s, you tried to make even more money.

73
Q

What did you do the day after the next day after selling your car? Did you see or talk to anyone?

A

You sat around the house and worked a bit on the deck

74
Q

what happened on august 11th?

A

You took the shuttle back up to Fat Cat’s right at noon, when it opened. This is not normal for you, but you are unemployed, so what else could you do?
you bought in $1,500 again, did pretty well, the cashed out at about $3,000. You don’t remember what you talked about with Dakota when you were trading your chips, besides talking about needing to pay back the bank. you asked Dakota for a check for $5,212.14.you gave the extra cash that would go into the check to Dakota, and you left at 3:30pm and headed home.

75
Q

How did you know the exact amount of money you owed for the check?

A

You saw that that was the amount due on your most recent mortgage statement. (electronically seen?)

76
Q

What did you do the day after you got your check printed at fat cat’s casino? (August 12th)

A

You walked to Kuigley Crossing branch and gave Harper the check.

77
Q

What happened when you gave Harper the check?

A

Harper seemed really happy, and asked how you came up with the money, and you told her about selling the car and going to the casino. You weren’t suspicious at all, other than feeling good about getting current on your payments.

78
Q

What happened the afternoon of August 12th after giving Harper the check?

A

A Cache County Sheriff’s Detective, who you know now to be Riley Reecher, questioned you.

79
Q

What did the Sheriff’s Detective question you about on August 12th the first time they showed up?

A

Riley asked you a bunch of really aggressive questions, but you don’t remember all of the details. You do remember Riley asking about a stolen car that was like yours, but light blue, not dark blue, but the detective didn’t seem to care. You told the detective what you did: that you sold the car to some guy on craigslist, and you didn’t know him. You told him you had been alone on Monday and Wednesday mornings.

80
Q

What happened immediately after the sheriff finished questioning you on august 12th?

A

The detective made you really uncomfortable, so you asked them to tell you what was going on. Riley gave a suspicious look and said “Not yet, but you’ll find out”. This irritated you- it sounded like something someone would say in a true crime film. you shut the door in his face and went back to working on your deck.

81
Q

On august 12th, after you were questioned by the sheriff’s detective and you resumed working on your deck, what happened?

A

Next thing you know, you were in handcuffs.

82
Q

Did you have anything to do with the two robberies?

A

No. you didn’t see the headlines regarding the robberies until after the detective’s visit. you were curious about what it all was about.

83
Q

What is your goal here?

A

you just want to clear your name

84
Q

When did you get fired?

A

January, 2023

85
Q

when did you start your construction project?

A

2022
