Elements of Battery
A
A defendant is liable to the plaintiff for battery if the plaintiff can prove with a preponderance of evidence that:
(1) The defendant and plaintiff made bodily contact (direct or indirect);
(2) The contact was harmful of offensive;
(3) The defendant caused the contact;
(3) The defendant intended the contact or apprehension of contact.
