A person licensed by the state to process paperwork and collect money to get someone out of jail on a bond
Bail Agent
A decision to have a case examined by a higher court
Appeal
Your first court appearance before a judge
Arraignment
A bond executed on a person as a result of a charge or an offense so they may be released from jail
Bail bond
The act of freeing a person from a charge by means of a decision, verdict or other legal process
Acquit
The person has been legal confined either through the court or law enforcement and is usually in jail
Custody
One who flees the law to avoid, evade or escape some penalty or consequence
Fugitive
A formal written document accusing a person of having committed a felony or a misdemeanor
Indictment
Securing,through a third party,away to recover losses in the event the bond must be forfeited
Indemnification
This is commonly referred to as an appearance bond which is delivered immediately to the clerk of the court to be recorded
Recognizance
Assets such as cash,securities,inventory,letters of credit or physical property used to apply to a bond
Collateral
The person in charge,in this instance,the insurance commissioner
Commissioner
A person who has been charged with a crime
Defendant
The surrender of a criminal by a foreign state to which he has fled or sought refuge from prosecution in the requesting state
Extradition
A document (policy) which ensures full payment of that which is insured,once a premium has been paid
Insurance
Means any domestic,foreign or alien surety company which has qualified generally to transact surety business under the requirements of this title and specifically to transact bail bond business in this state
Insurer
A party that takes responsibility for the liability on a bond for the original party (defendant)
Surety
A person who is offered or given any compensation by a bail agent or surety in exchange for assisting the bail agent or surety in apprehending or surrendering any defendant or keeping a defendant under surveillance
Recovery agent
Any licensed bail agent,acting on behalf of an authorized surety company,must attach to each bond,a numbered original properly executed “power of attorney “from the insurance company in an amount of at least the penalty of the bond (full amount of bond)
Power of attorney
The percentage of the bail paid to the bond agent and cannot exceed 10%
Premium
A process taken to insure property can be foreclosed on if the contract is forfeited
Lien
A general name for any criminal offense that is more serious than an infraction yet not legally called a felony
Misdemeanor
Your property becomes security as bail money. Only the equity on the property will be considered and the court will take a lien on the property. If you fta, they can foreclose.
