Difference between competence and capacity?

A

Competence - you either are or you are not competent. Generally you are assumed comptent if you are an adult. It is a legal status.

Capacity - Can temporarily lose capacity to make decisions, independent of your competence. Examples of this could include injury, substance abuse, or mental illness.
Also those without legal competence, could retain some decisional capacity - diet, clothing, relationships, etc.
