Four members must be licensed brokers, each of whom has held an active license for five years preceding appointment. One member must be a licensed broker or a licensed sales associate who has held an active license for two years preceding appointment. Two members must be persons who are not, and have never been, brokers or sales associates. At least one member of the Commission must be 60 years of age or older. Members of the Commission shall be appointed for four-year terms.

DRE

A

The Division of Real Estate (DRE) protects the public by regulation of real estate and appraisal licensees pursuant to Chapter 475, Florida Statutes. The Division is responsible for the examination, licensing and regulation of over a quarter of a million individuals, corporations, real estate schools and instructors. Its mission is stated as protecting the public by regulation of real estate and appraisal licensees through education and compliance.

License Application

A

When the Commission denies an application, it sends a copy of the denial to the applicant, lists the reasons for the denial, and advises that the applicant has 21 days from the date of receipt of the order to request a hearing in accordance with Chapter 120, F.S.

When an applicant receives a Notice of Intent to Deny, the applicant has two options:

  1. An informal hearing to appear before the Florida Real Estate Commission,

Or

  1. A formal hearing in front of an administrative law judge may be requested.

Sales Associate License

A

Sales associates are required to successfully complete a prescribed post-licensing education requirement before the first renewal of their licenses. This requirement has the effect of placing all initial licenses in a conditional (probationary) status because failure to complete the post-licensing education requirement will cause the initial license to become null and void by operation of law. Sales associates who do not complete the 45-hour post licensing requirement and want to continue in the real estate business are required to requalify for licensure by repeating the pre license course and end-of-course exam and by again passing the state licensing exam.

DBPR

A

The Department of Business and Professional Regulation (DBPR) is responsible for licensing a diverse group of professions, including realtors, certified public accountants, boxers, community association managers, construction and electrical contractors, cosmetologists and veterinarians. DBPR also investigates unlicensed activity to protect both licensees and consumers.

Post License

A

Two post-license courses for brokers are required during the first licensure period as a broker.

A broker must complete the 60-hour post-licensing course within the initial renewal period, prior to the expiration date of the broker’s initial license.

Continuing Ed

A

All licensees must renew their real estate licenses every two years after the initial license period. During the first renewal period.

After that first renewal, all other renewals will require continuing education courses.

A licensee may reactivate a license which has been involuntarily inactive 12 months or less, by satisfactorily completing a 14-hour Commission-prescribed continuing education course.

If the involuntary inactive status is more than 12 months, but less than 24 months, the individual is required to complete ANOTHER 14 hours of continuing education, in addition to the 14 hours required for the first year on involuntary inactive status.

Licensees who have remained involuntarily inactive by not renewing their continuing education for more than 2 years will have their licenses become null and void.
