Assessment of the UK Constitution Flashcards

1
Q

Why is its uncodified nature an advantage?

A

It’s neither codified or entrenched, so it’s flexible and adaptable and can be easily changed to react to changing circumstances, demonstrated in the 2010 General Election when there were no fixed constitutional rules to deal with the indecisive result. Gus O’Donnell (the Cabinet Secretary) had drawn up draft procedures for the possibility of a hung parliament. His plan worked well and the new coalition government was installed with relatively little disruption or conflict.

Q

Why is its traditional quality an advantage?

A

It is traditional and stood the test of time. The fact that Britain hasn’t suffered a violent revolution or major political unrest since the 17th century civil war suggest that the constitution has enduring qualities.

Q

Why could the lack of separation of powers be considered a disadvantage?

A

The lack of separation of powers between government and Parliament means that government tends to dominate Parliament. This is often seen as undemocratic as Parliament represents the interest of the people.
