What constitutes an injury
physical injury or
harm to mental health
whether temporary or permanent
What does physical injury include
- Unconsciousness
- disfigurement
- substantial pain
- infection with a disease
- impairment of bodily function
What is the definition of harm to mental health
- what does it include and not include
s.15 CA 1958 defines harm to mental health to be including
Psychological harm
but does not include
an emotional reaction i.e distress, fear, anger
unless it results in psychological harm
What does Serious Injury mean
A) Any injury (including the cumulative effect of more than one injury) that:
- Endangers life
- substantial and protracted Or
B) The destruction, other than the course of a medical procedure of foetus in pregnant woman
What does RECKLESSLY mean re: assaults
The accused must have been aware
that their conduct would probably cause Serious Injury
What does INTENTIONALLY mean re: assaults
Accused intended to cause SERIOUS INJURY
