What two elements of arrest must be satisfied?
Involved or suspected to be involved in an offence
Reasonable ground that the arrest is necessary
What six reasons make an arrest necessary?
Get a persons name Get a persons address Prevent injury, damage, indecency or obstruction Protect a vulnerable person Ensure a prompt investigation Prevent a suspect from disappearing
What 4 reasons might a judge issue a warrant for arrest?
Payment for fines
Appear in court
Answer bail
Witness to attend at court
When is a ‘when questioned’ caution used?
At arrest and interview
When is a ‘Now caution’ used?
Juts before a person is charged with an offence
When is a ‘restricted caution’ used?
For interviews after charge
What is the caution speech?
You do not have to say anything but it may harm your defence if you do not mention when questioned something which you later rely on in court. Anything you do say may be given in evidence.
What are the two categories of unsolicited comments?
Relevant comment- includes anything which may be relevant to the offence
Significant statement- anything which could be used in evidence against the suspect
