Private Int Law:

A

These are domestic laws. They aare basically laws about about how will a country deal with iternational law. They define in which cases and how much will international laws overrule domestic laws and vice-versa.

A

A

Will arise where the law of two different countries produces different outcomes, making if difficult for aprties in those countries to trade with one another.

International treaties, conventions and model codes:

A

Public international law arises out of the problem of conflict of laws.
* Nations negotiate treaties and model codes so that parties can refer to that agreed code of
conduct when carrying out international trade rather than their own domestic laws.
* International bodies exist to help create, manage and amend those agreed international
laws.

United Nations (UN)

A
  • Global body which has almost every country in the world as a member, which exists to maintian peace and security, develop friendly relations between nations, co-operate in solving economic, social, cultural, humanitatrian problems and to promote respect for human rights and international freedoms.
  • Legal depts -
    (a) UNICITRAL (UN commission on int trade law) - 61 member states. Has 6 working groups.
    (b) ICJ (Int COurt of justice.

  • Created by business leaders from various countries which aims to serve world buisiness community by promoting trade and investment, open markets fro goods and services and the free flow of capital.
  • They help i ease of doing int biz and also advice the UN.
  • World council - chief authority of the ICC.

  • Has an executive board of 15 - 30 members elected for 3 years, with 1/3rd members retiring every year.
  • they make ICC policies.
  • WC also elects a chairman and vice chairman who make recommendations to the board.
  • National committees represent ICC in their National states
  • The secretariat, headed by a general secretary, ensure the implementation of ICC policies in members.

World Trd Org (WTO)

A
  • Provides rules for the system of international trade.
  • Was formed from the old Generla Agreement on Tariffs and trade (GATT). The WTO provides guidance on trade in goods, services, inventions, creations, intellectual properties.
  • It has 149 members - accountable for 97% of global trade.
  • AIm - improve the global trade ecosystem.
  • Appeals are heard by 3 members of the appellate body.
