Define protected animals
Protected animals are defined as one which is commonly domesticated and the British Isles, under the control of man on a permanent or temporary basis
For example farmed salmon are covered but free running Salmon are not same for rabbits etc
Define an animal
An animal is defined as an animal with A vertebrate excluding humans. It does not cover vertebrates which are an embryonic or foetal form
What offences created by sec 19 of the animal health and welfare Scotland act 2006?
Creates an offence for any person if they cause a protected animal unnecessary suffering by an act they knew or ought to have reasonably known that what they were doing would cause such suffering or would be likely to do so.
Example: leaving a dog in a car sunny day without adequate ventilation or overloading a lorry with sheep
In most cases obtain assistance from an inspector from the SSPCA, to examine as they are experts
With regard to sec 18 of the animal health and welfare of Scotland act 2006 who is responsible for animals?
This is a person is responsible from animal on a permanent or temporary basis. It also includes being in charge of it, however the person who owns is always regarded as being responsible.
A person under 16 years of age cannot be responsible for an animal
A person who owns an animal and then abandons it does not relinquish responsibility
What offence is created by sec 24 of the animal health and welfare of Scotland act 2006?
A person who is responsible commits an offence if they do not take steps that are reasonable in the circumstances to ensure that the needs of an animal are met as required by good practice
The animals needs include:
Suitable environment
Suitable diet
Need to exhibit normal behaviour patterns
Housed with or apart from other animals
Protected from suffering, injury and disease
Define an animal fight?
An animal fight is any occasion on which are protected animal is placed with an animal or a human for the purposes of fighting wrestling or baiting
What might a person do to commit an offence under sec 23 of the animal health and welfare of Scotland act 2006?
Keep or train an animal for an animal fight
Possess without lawful authority Rachel about excuse any equipment which is designed or adapted for use in an animal fight e.g. cock spurs
Cause an animal fight take place
Arrange an animal fight
participate in making/carrying out arrangements for an animal fight
Hello premises to be used for more charging admission to attend an animal fight

Sec 22 of the animal health and welfare Scotland act creates what offence?
A person (including a responsible person for an animal) commits an offence if without lawful authority or reasonable excuse they
Administer a poisonous or injurious drug or substance to a protected animal
Causes such a drug or substance to be taken by protected animal
Permit another person to administer poisonous or injurious substance to an animal
Fails to take reasonable steps to prevent this from happening
Using the pneumonic SHAMFPOGDC, list domesticated animals
Sheep, horse, ass, mule, fowl, pig, ox, goat dog, cat
Or any other animal sufficiently trained to serve man’s purpose
