What is the world’s largest minority group?
People with disabilities
Define disability
A physical or mental impairment that substantially limits one or more major life activities of the individual; or a record of such an impairment; or being regarded as having such an impairment, or known association or relationship with a person with a disability
What is an example of a record of a disability?
A person who has recovered from cancer or mental illness
What is “regarded as having a disability”
Regarded as having substantially limiting impairment, even though they may not have such an impairment. e.g. someone with vitiglio
What is “known association or relationship”?
Having a child with a disability may make others assume you have excessive responsibilities that effect your ability to do essential functions
What is not covered under the ADA?
Minor, non-chronic conditions of short duration such as sprain, broken limb, or the flu.
What is a covered entitiy?
An employer, employment agency, labor organization, joint labor action committee, and state/local governments
What is a reasonable accomodation?
Modifications at the job to enable a person with a disability to easily perform a specific job e.g. work schedule mod, mod of physical activity, adapt furniture, accessible restroom
What is undue burdon?
An action necessary to provide a reasonable accommodation that would cause the employer significant difficulty or expense.
What is an essential function?
Reflects the primary reason the job exists and are performed by all workers who hold the job.
Who is a qualified individual with a disability?
Someone who meets legitimate skill, experience, education or other requirements and can perform the essential functions of the position with or without reasonable accommodations.
What is Title I?
Employment protection
When can a job require a physical agility or fitness test?
Pre-offer only. NOT a medical test. Must be given to ALL applicants.
When can a job require a medical examination?
Post-offer ONLY. Only if the medical test is job-related and consistent with business necessity. Must be required of ALL entering employees.
When can drug tests be required?
Pre or Post-offer
