Name of the Convention on Airspace
Convention on International Civil Aviation
Art. 1 and 2 Convention on International Civil Airspace
- The contracting Stats recognize that every State has complete and exclusive sovereignity over the airspace above its territory
- The State’s territory includes territorial waters
Art. 5 CICA, + aircraft registration, + high seas, +ADIZ
Each contracting State agrees that all aircraft of the other contracting States, being aircraft not engaged in scheduled intnernational air services shall have the right, subject to the observance of the terms of this Convention, to make flights into or in transit non-stop across its territory and the necessity of obtaining prior permission, and subject to the right of the State flown over to require landing (= two technical freedoms of the air)
Scheduled international air services– bilateral agreeements (– commercial freedoms of the air)
Aircraft– subject to registration (flag)– nationality of the flag State= exclusive jurisdiction of the flag State in the airspace above the high seas
Airspace above the high seas= beyond the limits of national jurisdiction= freedom of use
ADIZ (ari defence identification zones)= zones extending beyond territorial airspace for the security and prevention purposes
