Conditions of general Parole (Do’s)
- Obey all laws and ordinances
- Report in person to your district parole supervisor or their representative, immediately after you are released on Parole from the institution, unless u have written instructions from the board stating otherwise
- Notify me immediately after any arrest, if you’ve been served with a complaint or summons and after accepting any bail or Pre trial release
- Domestic violence thing
- Obtain my approval prior to changing residence or leaving the state(for any reason)
- Make payments to the division of parole of any assessment, fine, penalty, lab fee or restitution imposed by the sentencing court
- Register with the appropriate law enforcement agency when u settle into a place or move to a new placeif you are subject to the provisions of N.J.S.A 2c:7-2
- Submit to a drug or alcohol test whenever I want
- Notify me if your employment status changes
- Submit to a search conducted by me without a warrant of your person, place of residence, vehicle, or any other personal property within your control at any time a parole officer has a reasonable and articulable basis to believe that the search will produce contraband or evidence that the condition of supervision has been or is about to be violated. And permit the confiscation of any contraband. I need clarification about if I need reasonable suspicion to do the search. In the parole paperwork it doesn’t say I do, but on the net it does
Conditions of General Parole (dont’s)
- You’re not to own or possess any weapon enumerated in 2C:39-1R
- No firearms as defined in 2C:39-1f
- Can’t use, poses or distribute a controlled dangerous substance, controlled substance analog or imitation controlled dangerous substance defined in 2C:35-2 and 2C:35-11
- Don’t do anything that will result in the issuance of a final restraining order pursuant in 2C:25-17
- No motor vehicle without a license
- Waive extradition to the state of NJ from any jurisdiction in which you’re apprehended for violation of this parole status and u can’t contest any effort to return u to NJ
Extra Conditions of PSL/CSL parole (Do’s)
- Report to me as instructed
- Notify me upon the issuance by the appropriate court, pursuant to the prevention of domestic violence act 2C:25-17 or the provisions of a similar federal statute, of an order granting emergency relief, a temporary or final restraining order or an order establishing conditions of release or bail in a criminal matter or offense arising out of a DV situation and comply with any conditions after
- Reside at a residence approved by me
- Cooperate in any medical and or psychological examination or tests that the PO wants
- Participate in and successfully complete an appropriate community or residential counseling or treatment program as directed by me
- Obtain my permission prior to securing, accepting or engaging in any employment business or volunteer activity and prior to change of employment
- Comply with any curfew
- Pursuant to N.J.S.A. 30:4-123:88 the state parole board, on at least an annual basis, gives a polygraph exam that u have to take
- If the sentencing court determines the behavior was repetitive and compulsive and commits you to an adult diagnostic and treatment center for a program of specialized treatment, the offender must complete the program
* all conditions of general parole must be followed too
Conditions of PSL/CSL (dont’s)
- Refrain from any contact (verbal, written or through a third party) with the victims of the offense unless I authorize contact
- Refrain from any contact (written or otherwise) with any group, club, association or organization that engages in, promotes, or encourages illegal or sexually deviant behavior
- No social media, even under an alias, unless I approve
- If the victim was a minor, the offender shall:
Refrain from initiating establishing or maintain contact with any minor
Refrain from attempting to initiate, establish or maintain contact with any minor and refrain from residing with any minor w/o approval from the district parole supervisor or designated representative
- Here’s the exceptions to the minor rule:
A) when the minor is engages in lawful commercial or business activity, the offender may engage provided the activity takes place in open public view
B) when the minor is in the physical presence of his or her parent (the offender doesn’t count)
C) court authorized it
D) parole supervisor or designated representative may authorize the offender to have contact with the minor
E) when offender is present in public area as long as the offender is not associating with the minor and the public area isn’t one frequented mainly or exclusive by minors
- No alcohol if the county prosecutor and court say so or if the board does
- No delivery jobs, no jobs that focus on minor or alcohol jobs
* all conditions of general parole must be followed too
What’s a parole counselor ?
They figure out an inmates eligibility date; monitor their progress; let them know details of the parole process prior to release. These are the ones on the inside
When are people eligible for parole
After serving 1/3 of your jail sentence people become eligible.
All state offenders must serve at least 9 months and all country must serve at least 90 days before being eligible. For county jail folks they do one hearing to determine parole eligibility
If you have a mandatory minimum then as long as your mandatory minimum is greater than 1/3 of your maximum sentence. Example- your sentence to 20 years with a mandatory minimum of 12, you’re eligible after 12 cuz it’s greater than 1/3 of the max
Jail credits AKA time served in jail during trial can beat this time down a little, work credits earned for working in jail can too. So can commutation time which is automatically given up front as an assumptive motivator that you’ll behave in jail. If u misbehave in jail, DOC can take away some of your commutation time thus lengthening your sentence and getting it closer to the actual 1/3. Which brings me to my next point, this communtation time isnt included in the 1/3 thing. So if u get 6 years, you’ll have to serve at least 2, but with commutation time untouched if u behave, it’ll be less than 2 off the bat
“Exceptional progress” in jail. If you think you’ve made that it’ll speed up the time until you’re eligible for parole as well. Contact a parole counselor if u think u do. The board panel decides, but you gotta be eligible for parole within 2 and a half years and basically be an angel in jail
Parole Plan?
It’s where u tell a counselor where u wanna live, and what u wanna do when released. The district office looks at this and approves it or not, after investigating it. They tell the parole board what they think. The board panel can reject it or approve it. They’re looking to see if u have a decent plan (place to live, work or school plan )
If you don’t have what we deem to be an acceptable place to live we find u a place in a residential program or some other kind of assistance
We want them set up for success
You can be paroled directly out of state if the office of interstate services approve and the Nj board does too
