A

a system where two parties oppose one another, where the case is presided over by an impartial, independent third party
- each side presents witnesses and evidence to argue their side
- each side also test the evidence of the other side through cross examination

A
  • critics argue that the skill of a legal personnel impacts the case, and does the lack of legal knowledge of the jury
  • witnesses can be subjected to intense scrutiny and can be especially difficult for victims
  • expensive costs, slow process
  • focus put on winning a case rather than justice for society/ victim/ accused
