an appointment of an agent to make healthcare decisions on behalf of the principal.
When does a durable healthcare power take effect?
When the testator becomes incapacitated.
What are the formalities for a durable healthcare power?
They must be in writing, signed by the testator, and witnessed by two adult witnesses.
How is a living will revoked?
by writing, physical act, or by oral declaration evincing intent to revoke.
How is a durable healthcare power revoked?
by a written or oral revocation made to the agent of to the testator’s healthcare facility.
What authority does an agent have under a durable healthcare power?
the agent has the authority to make any healthcare decisions on the principal’s behalf that the principal could have made for himself while having capacity.
