What does the adult with incapacity act 2000 state
Allows intervention in an adult’s welfare and finically affairs where the adult lacks capacity
What does the mental health act 2003 state
Enables medical professionals to detain and treat people on the grounds of mental disorder
What did the adult support and protection(ASP) 2007 state
Introduced new measures to identify and protect “adults at risk of harm”
What is the 3 point test
A test to measure an adult at risk, all 3points MUST be met:
Adults ages over 16 who,
1) are unable to safeguard their own well being, prosperity, rights or other interests
2) are at risk of harm; and
3) because they are affected by disability, mental disorder, illness or physical or mental infirmity, are more vulnerable to being harmed than adults who are not so affected
When would a adult be deemed at ‘risk of harm’
Another persons conduct is causing (or likely to cause) the adult harm
The adult is engaging (or likely to engage) in conduct, which causes (or likely causes) self harm
What are the 2 main principles of the ASP act
Intervention must benefit the adult
Be the least restrictive option
What are the other principles of the the ASP act
Have regard to the adults ascertainable wishes
Take account of the views of the adults nearest relative, primary cared, guardian or attorney
Take account of the views of any person who has in interest in the adults well being or property
Encourage participation of the adult as fully as possible
Provision of info and support to enable the adult to participate
Ensure the adult is not treated less favourably than any other adult in a comparable situation
Take account of the adults abilities, background and characteristics
What does the ASP act allow councils/local Authorities to do
Places a satutory duty on them to:
Make inquiries about an adults well being, property or Financial affairs, determine if the 3point test is met and to determine if further action is required to stop or prevent harm from occurring
It is the responsibility of social work to lead on the adult protection inquiry or investigation
Where inquires have established that a formal ASP investigation is required it must be led by a council officer
Council officer can interview adult but must inform right to not answer
Duty to consider importance of providing advocacy and other services

What is the timescale of a ASP referral
Acknowledgment of referral within 1 working day
Duty to inquire within 5 days
Investigation within 20 days
Case conference within 20 days
Protection plan made within 10 days of conference
3 monthly reviews if subject to ASP care management
What are the protection orders
Assessment order- allows the adult to be taken to a more suitable place for interview or med examination
Removal order- permits the adult to be moved to any place to protect them from harm
Banning order- and temporary banning order bans the subject of the order from a specified place
What are the 3 R’s to report concerns
Recognise- spot signs do something
Record- listen carefully, believe and take short notes
Report- tell someone
