A

No. Although almost all the time it will require an explicit contractual provision to create a property interest, a property interest can be created without one. It is a rare exception though and requires a large amount of evidence to prove.

What is the “bitter with the sweet” test found in Arnett v. Kennedy?

A

If a statute creates the property interest, it also provides the procedures for protection of that right. Thats all the person gets because they must take the bitter with the sweet.

Wisconsin v. Consta. & Paul v. Davis

Is stigma enough to violate a persons liberty interest?

A

No. Stigma alone is not enough. There must be something more to prove a liberty interest violation.
Wisconsin restricted his ability to buy alcohol, which he had a legal right to do.
Paul was simply embarrassed and upset. But his legal rights were still intact.
