A

Event = Time; EoT. Circumstances beyond the control of contractor. Matter = Money; employer liable to pay contractor for direct loss of money through circumstances beyond the control of contractor.

A

All variation valuation to be sanctioned by CA. Key points include:

  • Valuations of substituted or additional work of similar character and quality as work set out in the contract documents rates and prices can be used to determine value.
  • Where variation is similar in character but not executed under similar conditions, contract rates and prices can be basis but with fair allowance for difference in conditions.
  • Where the work is not similar in character, works to be valued at fair rates and prices.
