A
There must be an act
Generally, but not always, omission to act is not sufficient to find criminal liability

Criminal Omissions to Act
A
When there is a legal duty (i.e. statute requiring act [like tax returns], doctor-patient relationship, parent-child relationship)

Voluntary Requirement
A
The act must be voluntary, if the defendant is unconscious, in an automatistic state, sleepwalking, etc this does not count. Intoxication not included

Concurrence
A
The act must be accompanied by some evil state of mind
