A
  • “but for” test (R v Pagett)
  • more than de minimis (R v Hughes)

How do you find factual causation?

A
  • Thin skull rule: take your victim as you find them (R v blaue)
  • Novus Actus Interveniens (R v Pagett) - girlfriend a shield has foreseeable consequences
  • Medical treatment : unlikely to break the chain of causation (R v Smith) unless the error is totally unrelated to the injury (R v Jordan)
  • Rejecting medical treatment is not Novus actus (R v Blaue)
  • Victim’s own act if foreseeable, not Novus actus (R v Roberts)
