When must a defendant file an AOS?
A
A defendant must file an acknowledgment of service if
(a) they are unable to file a defence within the period specified in rule 15.4 (14 days); or
(b) they wish to dispute the court’s jurisdiction.

What can the claimant do if an AOS is not filed?
A
The claimant can apply for default judgment under Part 12.3 (1).

When does a defendant file an AOS?
A
- Within 14 days of service of the claim form and POC; or
- Within 14 days of service of the POC if they are served separate from the claim form.

What is included in the AOS?
A
- It must admit, partially admit or deny the claim.
- It must be signed by the defendant or their representative.
- It must include their address for service.
- It must set out the defendant’s full name if the claim form has incorrectly stated it.
