Elements: Accomplice Liability

A

If you aid, abet, encourage, or facilitate the crime with the intent the crime be committed, you can be found guilty of that crime
1. Aiding, abetting, encouraging, or facilitating ( must be active involvement, words or mere presence not enough)
2. Must have intent that they help with crime AND intent that the charged crime is completed

Legal assistance: intent can be inferred when an accomplice renders legal assistance if the accomplice has knowledge and a stake in the outcome. Must have knowledge of the illegal purpose and a stake in the outcome

Who are the Parties to the crime and what are their roles?

A

Principal- person actually engaging in the crime
Accomplice- someone who, with the intent that the crime be committed, aids, counsels, or encourages the principal
Accomplice after the fact- someone who shields, shelters or assits another knowing that they person has committed a felony to help t hem escape arrest, trial, or conviction

Accomplice- guilty of underlying offense
Accomplice after the fact- guilyt of lesser offense of “accessory after the fact”

Scope of liability is for the intended crime and all other foreseeable crimes committed by the principals
