What are the parties to an accomplice crime?
Principal, accomplice, or accessory after the fact.
Who a principal of the crime?
One who, with the intent to commit the crime, causes the crime to occur
Who an accomplice to the crime?
One who, with the intent the crime be committed, aides, counsels, or encourages the principal.
Note: silent approval is not enough
Who is an accessory after the fact to a crime?
One who, with the intent to help a felon escape or avoid arrest or trail, relieves, or assists a known felon after the felony has been completed.
What is the principal liable for?
The crime he committed
What is the accomplice liable for?
The crimes the principal committed that the accomplice assisted, counseled, or encouraged. The accomplice is also liable for all crimes that were foreseeable.
What is the accessory after the fact liable for?
Majority rule: not liable for the crimes of the principal but rather a separate crime of “obstructing justice”
