Mens rea
The state must prove two elements:
(1) the intent to assist another in the commission of the offense
(2) the mens rea required for the conviction of that offense
Scope
AccL attaches to the natural and probable consequences that arise out of the assisted offense
MPC addition
Recognizes accomplice liability for an attempt to aid a crime, even if the perpetrator never engaged in conduct that would constitute an attempt to commit the crime
Actus reus
Assistance required does not need to be significant but mere presence at the scene of the crim is usually insufficient to establish liability
Modern Statutory Abandonment
A person who abandons the criminal act for which assistance was provided may be able to avoid liability if the criminal act does not take place. The abandonment must be complete and voluntary.
MPC legal accountability
One person is legally accountable for the conduct of another if the person has the requiste mens rea for the crime when they:
(1) cause an innocent or irresponsible person to engage in the conduct;
or (2) if the person is an accomplice
MPC accomplice
A person who, acting with the purpose of promoting or facilitating the commission of the offense, solicits, aids, agrees to aid, or attempts to aid another in planning or committing a crime
