Accessory After The Fact Legislation
S71 CA 1961
Elements:
Person being assisted is party to an offence that has been committed.
At the time of receiving, comforting or assisting person knows that said person was a party to an offence.
Actively tampers or suppresses evidence against said person
To enable said person to escape arrest OR to avoid arrest OR conviction
R v Mane
To e considered an accessory after the fact the acts done by the person must be after the completion of the offence.
R v Crooks
Must have knowledge that person assisted was a party to the relevant offence.
R v Briggs
As with a receiving charge, knowledge may also be inferred from wilful blindness or a deliberate abstention from making inquiries that would confirm the suspected truth.
