Equality Act 2010
Recognizes it is unlawful to discriminate against people in respect of their disabilities,
in relation to employment and the provision of goods and services.
Equality Act 2010 replaces
The Disability Rights Commission – April 2000.
The Disability Discrimination Act 1995 (DDA).
Equality Act 2010 protects the following characteristics from discrimination
Age. Disability. Gender reassignment. Marriage and Civil Partnership. Pregnancy and maternity. Race. Religion or belief. Sex. Sexual orientation.
Approved Documents Part M
Requires inclusive ease of access to, and circulation within all buildings & facilities for disabled people.
Domestic Handbook 2015 and the Non-Domestic Handbook 2015
Building regs concerning access in Scotland are contained in these handbooks
Design and Access Statement (D&A)
Required for buildings of more than 1,000 m2, housing developments of 10 dwellings or more and developments requiring listed building consent.
In conservation areas, design and access statements are required for single dwellings or buildings of more than 100 m2.
Design and access statements should explain
Amount. Layout. Scale. Landscaping. Appearance of the development. Context. Use. Access.
D&A Amount
For residential development, this the number of proposed units and for all other development, the proposed floor space for each proposed use.
D&A Layout
The relationship between buildings and public and private spaces within and around the site.
Accessibility of the site for users, such as travel distances and gradients
Orientation of blocks and units in relation topography to afford optimum accessibility.
Layout impact on the energy consumption and thermal comfort during winter and summer performance.
Crime prevention measures.
D&A Scale
Height, width and length of a building(s) in relation to its surroundings.
How they relate to the site’s surroundings and skyline.
How they relate to the human scale.
D&A Landscaping
Purpose of landscaping private and public spaces.
Its relationship to the surrounding area.
A schedule of planting and landscaping materials.
D&A Appearance of the development
The appearance of the place or buildings proposed.
How relates to appearance & character of surroundings.
How texture, contrast, tone and lighting have considered accessibility.
D&A Context
Steps taken to understand the local context (physical, social and economic characteristics, planning policies).
How local context has influenced the design.
Consultation with the local community groups as well as with LA, building control, conservation and design and access officers. Explanation of how their views have been take into account.
Opportunities, constraints and conflicting issues.
D&A Use
Proposed use(s).
Their distribution across the site.
Accessibility to and between them.
Their relationship to uses surrounding the site.
D&A Access
Access to buildings, spaces and transport.
Flexibility and responsiveness to changing needs.
Access for emergency services if appropriate.
