A

A timely manifestation of assent to the terms of the offeror

Only person to whom the offeree begins performance is made can accept
Not limited to single offerees
Only people who know about offer can accept offer

Silence

A

If recipient is present and knows services are being rendered with the expectation of compensation and by a word could’ve prevented a mistake and doesn’t correct it, then it is acceptance

Mailbox Rule

A
  1. Acceptances are effective upon dispatch when mailed, if properly addressed
  2. Rejections and revocations are effective when received
  3. If rejection is sent first then an acceptance, mailbox rule is out = whichever the person receives first is valid
  4. Mailbox rule doesn’t apply if offeror opts out (explicitly stating that acceptance is effective upon receipt, not dispatch)
  5. Acceptance under an option contact is effective only upon receipt
